Third-Party Liability Insurance for Drone Operators—Mandatory Starting in 2025
Starting in January 2025, following an amendment to Poland’s aviation law, drone operators with takeoff weights ranging from 250 g to 20 kg will be required to have liability insurance. This is a significant change from previous regulations, under which coverage was required only for devices weighing more than 20 kg. The basis for these changes is the need to minimize the risk of accidents and potential damage to third parties or their property, as well as to align Polish regulations with EU regulations. If an operator does not have such a policy, they may be fined up to 4,000 PLN and may also be held fully liable for damages at their own expense.
Scope of Third-Party Liability Insurance Coverage
A drone operator’s liability insurance policy covers damages resulting from accidental damage to the property or health of third parties. This may include, for example, a collision between a drone and a vehicle or building, accidents resulting in bodily injury, or losses resulting from a drone crash due to a technical failure. The exact scope, as well as the coverage limit, depends on the insurer and the type of policy; however, for more demanding operations, it is definitely worth choosing an option that provides full coverage.
Who is subject to the liability insurance requirement?
Under the new regulations, the insurance requirement applies to drone operators using the devices for both recreational and commercial purposes. We would like to clarify that third-party liability insurance is not mandatory for the drone pilot, but for the operator—a distinction that is often confused and incorrectly used interchangeably. In most cases, policies cover flights classified as “open” and “special,” excluding the “certified” category, which is subject to special requirements. However, it is possible to purchase special insurance for these flights as well, though the coverage limits are higher in this case. Policy prices start at several dozen zlotys for coverage of recreational flights only, while for commercial flights, premiums range from 200 to 800 zlotys per year.
